Fortris™ AI Data Retention Policy

This Data Retention Policy describes how Battle Motors, Inc. (“Battle Motors”) retains, archives, and deletes Customer Data processed by the Fortris™ AI platform. It is incorporated by reference into the Fortris™ AI Terms of Service.
1. Purpose and Scope
Fortris retains only the data necessary to deliver the Services, comply with applicable law, and provide Customer with meaningful operational insight. This Policy balances operational utility with privacy and minimization.
Applies to all Customer Data collected through Fortris Hardware and Software.
2. Standard Retention Schedule

2.1 Retention periods run from date of data capture. Deletions run nightly. Deletion propagates to downstream systems within 7 days, full backup purge within 35-day PITR window.
3. Preserving Data Beyond Standard Retention
3.1 Flagging / Bookmarking Events: Users can flag events for preserved storage (retained for Subscription Term + 30 days).
3.2 Exporting: Dashboard download (MP4, CSV, JSON, PDF), API, Scheduled exports to S3/SFTP (Pro and Vision tiers).
3.3 Extended Retention Add-On:
- Video Extended 30 (30 days)
- Video Extended 90 (90 days)
- Telematics Extended 1Y (1 year)
- Telematics Extended 7Y (7 years)
Pricing per subscription per truck per month.
3.4 Legal Hold: Data under subpoena, court order, or litigation hold is retained until resolved.
4. AI Training and Aggregated Data
- De-identification: Customer Data used for model training is de-identified and aggregated.
- Aggregation: Only aggregated, non-personally-identifiable data is retained for AI training purposes.
- Opt-out for training: Available on the Vision tier.
- No sale of data: Battle Motors does not sell Customer Data.
- Deletion survives training: Individual records are not identifiable in trained models.
5. Customer Rights
- Access and export data via dashboard or API.
- Request correction of inaccurate data.
- Request deletion (honored within 30 days).
- Object to AI training.
- Receive certificate of data destruction on termination.
Individuals should direct rights requests to the Customer (data controller).
6. Data Handling at Termination
6.1 Transition Window:
- Days 0–30: Full read-access for export.
- Days 31–90: Read-only archive mode.
- Day 90: Decommissioned.
6.2 Deletion Procedure:
- Step 1: Logical deletion.
- Step 2: Crypto-erase (AWS KMS key destruction with 7-day waiting period).
- Step 3: Backup rotation (35-day PITR window).
6.3 Certificate of Destruction: Provided within 30 days of deletion completion (~120 days after termination).
6.4 Exceptions: De-identified/aggregated data, billing records (7 years), legal hold, security incident evidence.
7. Public-Sector and Records-Law Considerations
- Records-compliant retention: Extended Telematics 7Y add-on available.
- Litigation assistance: Battle Motors will cooperate with lawful records requests.
- Notice of third-party requests: Customer will be notified of third-party data requests unless prohibited by law.

9. Policy Review and Updates
This Policy is reviewed annually. Material changes will be communicated with 30 days’ advance notice.
