This Privacy Policy describes how Battle Motors, Inc. (“Battle Motors,” “we,” “us,” or “our”) collects, uses, protects, and shares information in connection with the Fortris™ AI platform (the “Services”). This Policy applies to Customers, Customer personnel, drivers and operators whose vehicles are equipped with Fortris Hardware, visitors to our websites, and anyone who otherwise interacts with us.
This Policy is incorporated by reference into the Fortris™ AI Terms of Service. If you are accessing Fortris as an employee or driver of a Battle Motors Customer, please note that your employer is the primary controller of data about you and has its own privacy notice that governs your relationship with the employer.
1. Our Role: Controller and Processor
Battle Motors plays two distinct roles depending on the data involved:
- Processor role (most Customer Data): when Battle Motors processes telematics, video, operational, and driver data on behalf of a Customer, the Customer is the data controller and Battle Motors is the data processor.
- Controller role (business operations): when Battle Motors collects information about its own Customers, website visitors, prospective customers, and business contacts, Battle Motors is the data controller.
2. Information We Collect
2.1 From Vehicles and Hardware (Customer Data — Processor Role)
We collect the following types of data from vehicles and hardware:
- Telematics data (GPS, speed, heading, ignition, engine hours, idle time)
- CAN bus / J1939 data
- Event data (hard-braking, harsh acceleration, cornering, seatbelt, speeding)
- Video and image data (Vision tier)
- Inputs from connected sensors
- Derived data (AI-generated classifications, risk scores, predictive maintenance)
2.2 From Users of the Fortris™ Platform
- Account information
- Authentication data
- Usage data
- User-generated content
- Support communications
2.3 From Visitors to Our Websites
- Contact information
- Technical data (IP, browser, device)
- Cookies and similar technologies
2.4 From Customers and Prospects
- Company name, billing address, contract terms, invoices, payment history, contacts

3.1 Customer Data (Processor Purposes)

4. AI and Machine Learning
- De-identification before training: training datasets are de-identified before data enters the training pipeline.
- Aggregated learning: models are trained across pooled data from many Customers.
- Opt-out for video (Vision tier): Vision-tier Customers may elect to opt out of AI training on video.
- No automated decision-making with legal effect: AI-generated scores and detections are decision-support outputs.
- Human review: detections that feed customer-facing workflows are available for review before action is taken.
5. When We Share Information
Battle Motors does not sell Customer Data. We share information in these limited circumstances:
5.1 With the Customer
Customer Data is shared with the Customer who controls it.
5.2 With Sub-processors
We use the following sub-processors: AWS, Datadog, Stripe, T-Mobile/AT&T, Samsung.
5.3 With Other Battle Motors Entities
Information may be shared among Battle Motors affiliates for the purposes described in this Policy.
5.4 For Legal Reasons
We may disclose information when required by law, regulation, or legal process.
5.5 In Business Transfers
In connection with a merger, acquisition, or sale of assets, information may be transferred.
5.6 With Your Consent
We may share information with your explicit consent.
5.7 We Do Not Sell Personal Information
Battle Motors does not sell personal information as defined under applicable privacy laws.
6. How We Protect Information
6.1 Infrastructure
AWS us-east-1, private subnets, WAF, multi-tenant isolation.
6.2 Encryption
AES-256 at rest via AWS KMS, TLS 1.2+ in transit.
6.3 Access Control
Least privilege, MFA required, Zero Trust principles.
6.4 Threat Detection
Continuous monitoring via Datadog, GuardDuty, Security Hub.
6.5 Personnel Controls
Background checks, NDAs, security awareness training.
6.6 Backup and Disaster Recovery
Automated encrypted backups, annual restore drills.
6.7 No Warranty
No system is completely secure.
7. Cookies and Similar Technologies
We use the following categories of cookies: Strictly necessary, Analytics, and Marketing. The Fortris™ dashboard uses only strictly-necessary and analytics cookies.
8. How Long We Keep Information
- Video and images: 14 days (default)
- Telematics and operational data: 90 days (default)
- Account records: Subscription Term + 90 days
- Billing records: 7 years
- Audit logs: 1 year
- De-identified/aggregated data: indefinite

10. Children
The Services are not directed to children under 18. Battle Motors does not knowingly collect personal information from children under 18.
11. Public-Sector and Driver Notices
Customers are responsible for providing notices to and obtaining consents from their drivers and operators as required by applicable law.

14. Changes to This Policy
Battle Motors may update this Privacy Policy. Material changes that reduce individual rights will have at least thirty (30) days’ advance notice.
